Important: Powderseek is a travel marketing, referral and reseller platform. Unless a booking page expressly says otherwise, Powderseek is not the merchant of record, does not collect or hold the customer’s payment, and does not itself supply the travel product. The identified third-party supplier, booking platform or merchant contracts with you, takes payment, issues the booking confirmation and supplies or arranges the travel product.

1. About these Terms

These Terms govern your access to and use of the Powderseek website and any associated pages, applications, widgets, links and online services controlled by us (the Website).

By using the Website, creating an account or proceeding through a link or booking tool made available on the Website, you agree to these Terms. If you make a booking for another traveller, you confirm that you have authority to provide their information, accept applicable terms on their behalf and make them aware of those terms.

You must be at least 18 years old and have legal capacity to enter into a contract. If you do not agree to these Terms, do not use the Website.

The English version of these Terms prevails to the extent permitted by law. Any translation is provided for convenience only.

2. Our role and your booking contract

Powderseek displays and promotes accommodation, tours, activities, transport, ski products, packages and other travel-related products or services (Travel Products) supplied or arranged by independent third parties (Suppliers). We may receive a commission, referral fee, affiliate payment or advertising fee when you follow a link, enquire or make a booking.

Unless we expressly identify ourselves at checkout as the merchant or supplier:

  • we act only as a marketing, referral or booking-facilitation intermediary;

  • your contract for the Travel Product is with the Supplier or other merchant identified before payment;

  • payment is made to and processed by that Supplier, merchant or its payment provider, not by Powderseek;

  • the Supplier is responsible for accepting or rejecting the booking, issuing the booking confirmation, supplying the Travel Product and administering Supplier refunds or credits; and

  • Powderseek does not hold money on trust for you or the Supplier.

The identity of the contracting Supplier or merchant should appear on the relevant offer, booking page, checkout, payment statement or confirmation. You should not complete a booking unless you understand who the merchant is. Contact us before paying if this is unclear.

We are responsible for the services that we ourselves provide and for representations that we make. Nothing in these Terms excludes any responsibility that cannot lawfully be excluded.

3. Supplier terms

Each booking is also governed by the Supplier’s terms, including its cancellation, amendment, refund, no-show, minimum-participant, weather, safety, age, health, baggage and conduct rules (Supplier Terms). Supplier Terms are separate from these Terms and will generally be presented or linked before you book on the Supplier’s or merchant’s website.

You must read the Supplier Terms before booking. If these Terms conflict with Supplier Terms about delivery of a Travel Product, the Supplier Terms govern your contract with the Supplier. These Terms continue to govern your use of the Website and your relationship with Powderseek.

4. Information, availability and booking confirmation

Travel Product descriptions, inclusions, images, schedules, availability and prices are usually provided by Suppliers or third-party booking systems. We take reasonable care when publishing information but availability and details may change. You must check the final details displayed by the merchant before payment.

A search result, advertisement, itinerary suggestion or request to book is not a confirmed booking. A booking is confirmed only when the relevant Supplier or merchant issues a valid booking confirmation. Check the names, dates, times, location, inclusions and other details immediately and promptly report any error to the merchant and to us.

Images may be illustrative or seasonal. They must not be treated as a guarantee of weather, snow, scenery, crowd levels, wildlife sightings or exact appearance unless expressly stated by the Supplier.

5. Prices, currencies, taxes and fees

The merchant’s checkout page controls the final price and currency. Unless stated otherwise, displayed prices may be per person, subject to availability and subject to taxes, booking fees, local charges, resort fees, foreign-exchange movements or optional extras disclosed by the merchant before payment.

Your bank or card issuer may impose currency-conversion or international-transaction fees. Powderseek does not control those fees.

We will not describe a price as the total price if mandatory charges known to us are excluded. If a displayed price or description is an obvious error, the Supplier or merchant may correct it before a binding booking is confirmed, subject to applicable law.

6. Payment security

Powderseek does not ordinarily collect payment-card details for Travel Products. Payment is made through the identified Supplier, merchant or payment provider. Its payment and privacy terms apply.

Never send payment-card details through our contact form, email or social-media account. If the Website unexpectedly asks you to pay Powderseek directly for a Travel Product, verify the request through our published contact details before paying.

7. Changes, cancellations, no-shows and refunds

Your rights and costs depend on the Supplier Terms, the reason for the change or cancellation and any rights that apply under law.

7.1 Changes or cancellation by you

Requests must be made to the merchant or Supplier using the contact method in your booking confirmation. Supplier cancellation or amendment fees may apply. Powderseek cannot approve a refund, credit or change on the Supplier’s behalf unless the Supplier has expressly authorised us to do so.

7.2 Changes or cancellation by a Supplier

A Supplier may change or cancel a Travel Product for reasons permitted by its terms, including weather, safety, operational constraints or insufficient participants. The Supplier or merchant is responsible for the remedy it owes under its terms and applicable law. We may reasonably assist you to communicate with it, but we do not fund a Supplier’s refund from our commission unless required by law or separately agreed.

7.3 Refund timing and method

Any approved refund is ordinarily processed by the merchant that received your payment and returned to the original payment method. Processing time may depend on that merchant, its payment provider and your financial institution.

7.4 Australian Consumer Law

Supplier cancellation terms do not remove rights that cannot be excluded under the Australian Consumer Law. A cancellation does not automatically produce the same remedy in every case; the applicable remedy depends on the circumstances, the contract and the law. Nothing in these Terms limits any non-excludable right or remedy.

8. Supplier failure, insolvency and force majeure

Suppliers are independent businesses. To the extent permitted by law, Powderseek is not responsible for a Supplier’s insolvency, cessation of business or failure to provide a Travel Product, except to the extent caused or contributed to by our own breach, negligence or unlawful conduct.

Travel may be affected by events outside reasonable control, including severe weather, natural disaster, epidemic, government action, border closure, industrial action, transport disruption or civil disturbance. Rights and remedies in those circumstances depend on the Supplier Terms and applicable law. We recommend travel insurance suitable for your circumstances, but insurance may contain exclusions and is not a substitute for reading the policy.

9. Traveller responsibilities

You are responsible for:

  • providing complete and accurate traveller names, contact details, dates and other booking information;

  • checking booking confirmations and notifying the merchant promptly of errors;

  • passports, visas, permits, vaccinations, entry and transit requirements, and any required parental consents;

  • arriving on time and complying with Supplier safety, conduct, fitness, age and participation requirements;

  • considering official travel advice and your personal health, mobility and fitness; and

  • obtaining appropriate travel insurance where you choose to do so.

Entry and health requirements can change at short notice. Australian travellers should consult Smartraveller and the relevant embassy, consulate or official authority. Information on the Website is general information, not legal, medical, immigration or insurance advice.

Tell the Supplier before booking about any accessibility, dietary, medical or other requirement that may affect participation. A request is not guaranteed unless the Supplier confirms it.

10. Accounts and user content

An account is optional unless a feature requires one. You must keep login credentials secure, provide accurate information and promptly tell us if you suspect unauthorised use. You are responsible for activity carried out through your account except to the extent it results from our failure to take reasonable security precautions.

If you submit reviews, photographs, listings or other content, you confirm that you have the necessary rights and that the content is lawful, accurate in all material respects and not misleading, defamatory, discriminatory, abusive or infringing. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content for operating and promoting the Website. You retain ownership of your content.

We may moderate or remove content and suspend or close an account where reasonably necessary to protect users, enforce these Terms, comply with law, address security risks or discontinue a service. Where reasonably practicable, we will provide notice. Clauses intended to survive termination continue to apply.

11. Acceptable use

You must not:

  • use the Website unlawfully, fraudulently or in a way that infringes another person’s rights;

  • interfere with security, operation or access;

  • introduce malicious code;

  • scrape, crawl or use automated systems contrary to our published instructions or in a manner that places an unreasonable load on the Website; or

  • impersonate another person or submit false booking information.

12. Third-party websites, widgets and advertising

The Website may contain third-party links, embedded widgets, application programming interfaces and advertisements. Third parties control their own sites, systems, content, security, accessibility, terms and privacy practices. A link does not by itself amount to our endorsement.

We do not promise that a third-party coupon or promotion will remain available or be accepted. Please verify the final discount and booking details before payment. If an offer appears inaccurate or is not honoured, contact the merchant and tell us so that we can review the listing.

13. Intellectual property

Unless stated otherwise, the Website and its original text, design, software, branding and compilations are owned by or licensed to Powderseek and protected by intellectual-property laws. Supplier names, logos, images and content remain the property of their respective owners.

You may access and print Website content for personal, non-commercial use. You must not reproduce, modify, distribute, sell, republish or commercially exploit it without permission, except where permitted by law.

14. Privacy and communications

Our collection, use, disclosure and storage of personal information are described in our [Privacy Policy—INSERT CORRECT LINK]. Where necessary to respond to an enquiry or facilitate a booking, information may be disclosed to Suppliers, booking platforms and service providers, including recipients outside Australia. Their privacy policies may also apply.

If we send electronic marketing, we will do so in accordance with applicable law and provide a way to unsubscribe. Service messages about an enquiry, account or booking are not marketing messages.

15. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth) and its Australian Consumer Law.

Where we supply services to you, those services come with any consumer guarantees that apply, including that they will be provided with due care and skill and, where applicable, within a reasonable time.

16. Liability

Subject to clause 15 and to the maximum extent permitted by law:

  • we are not liable for acts, omissions, representations or insolvency of an independent Supplier, merchant, payment provider or other third party;

  • we are not liable for a Travel Product that we do not supply or for a booking contract to which we are not a party;

  • we are not liable for loss caused by your failure to comply with these Terms or Supplier Terms, or by inaccurate information supplied by you; and

  • we are not liable for indirect or consequential loss that was not reasonably foreseeable, except where liability cannot lawfully be excluded.

These limitations do not apply to loss to the extent caused by Powderseek’s negligence, fraud, wilful misconduct, breach of contract, misleading or deceptive conduct, or other liability that cannot be excluded by law.

No statement in these Terms requires a consumer to indemnify Powderseek for Powderseek’s own breach, negligence or unlawful conduct.

17. Indemnity for misuse

To the extent permitted by law, you indemnify Powderseek against third-party claims and reasonable direct costs arising from your unlawful use of the Website, your material breach of these Terms or your infringement of another person’s rights. This indemnity is reduced to the extent that Powderseek or another person caused or contributed to the claim or loss.

18. Complaints and assistance

For a problem with delivery, cancellation, refund or quality of a Travel Product, first contact the merchant shown on your booking confirmation. You may also contact us and we will provide reasonable referral assistance.

Please include your name, booking reference, merchant or Supplier, a description of the issue and the outcome sought. We aim to acknowledge complaints within [INSERT, e.g. 2] business days and provide a substantive response within [INSERT, e.g. 10] business days where reasonably practicable.

Nothing in this clause prevents you from contacting NSW Fair Trading, the Australian Competition and Consumer Commission or another competent regulator or dispute-resolution body.

19. Changes to the Website or these Terms

We may update the Website or these Terms for operational, security, legal or commercial reasons. The updated Terms apply from the effective date displayed above and will not retrospectively change an already confirmed booking unless required by law or agreed with you. If a change materially affects an account-based service, we will provide reasonable notice where practicable.

We may suspend, change or discontinue Website features. Nothing in this clause limits any right or remedy you have under applicable law.

20. Governing law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of courts and tribunals with jurisdiction in New South Wales. This does not prevent a consumer from exercising a right to bring a claim in another forum where applicable law permits it.

If any provision is invalid or unenforceable, it is to be read down to the extent necessary; if it cannot be read down, it is severed and the remaining provisions continue.
